The office of US Congressman Barney Frank, who is chairman of the House financial services committee, has confirmed that he is currently working on legislation to repeal the Unlawful Internet Gambling Enforcement Act.
The news item appeared this afternoon on the Financial Times website and has been confirmed to eGaming Review by Frank?s press department. The details of how any repeal would take action have not been worked out and no timeframe was given.
Frank is quoted as describing last autumn?s Act as one of the ?stupidest laws? ever passed and adds: ?I am working on legislation to cut back on this internet gambling thing? I think it?s preposterous?.
While rumours of Barney Frank?s support for a repeal of the Act had been circulating around the egaming industry in the past few weeks, Frank himself had not confirmed or commented on them. Shares in PartyGaming, 888 and Sportingbet were all up this afternoon.
The FT says the mid-term Democratic victory in the US Congress brought some hope to the online gaming sector and John Conyers, chairman of the House judiciary committee, is also considered sympathetic to the industry.
But while Frank and Conyers are ?powerful potential allies, it is far from clear that the lawmakers would have enough support to pass any meaningful legislation? because it is not clear ?whether the votes would be there for a regulatory bill?.
The FT adds that the US treasury is currently drafting the rules to implement the Act but that the deadline for presenting them has been missed and is now expected in April or May.

How about everyone trying to do something positive now?

The day after the bill passed, there were probably a lot of people who wish they would have at least picked up the phone. Well here's your chance again.

Take this opportunity to call not just your own Representative and Two Senators, but also call Representative Frank and offer him a few words of appreciation. I am sure he would appreciate the positive feedback since so often people only call when they are angry.

I re read the article and notice that it says he is working on legislation to 'cut it back' not repeal it. Big difference. My guess is he will try and get poker sites ok'd but us sports bettors will still be S.O.L.

Party was worth billions, Calvin - hundreds of millions... I'm sure Spiro, Henry, etc are all doing just fine... Work together. Hire some lobbyists and pay some people off. It's the American way.

Haha Ken, I said was Barney Frank your news and you said you didn't consider it newsworthy!

I hope you are right about more being done outside the lawmaker channel because no way he can get a repeal through. Once a law is passed all you can do is modify it unless its really an egregious law or you do something underhanded. I mentioned to someone today wouldn't it be funny if he snuck it onto something that must pass like funding for the Iraq war.

I can't see any way you can get lawmakers to vote in majority for essentially approval of online gambling. They might not care about banning it, but they certainly won't want their names out there as legalizing it unless it is part of a much bigger effort carving out the business for US operators.

My guess is at best he can get the regulations to be either dropped or put up with no teeth.

Even though I wrote on this site a month ago that Barney Frank and John Conyers were stand up guys and the best hope for the online gambling industry, let's not be naive about this: Not only would a repeal bill have to pass both chambers of congress with a majority, it would have to pass with a 2/3 majority. That's the only way it could survive a Bush veto. The odds that Bush would sign such a bill and alienate his constituency are about equal to the odds that Belmont will win the NCAA title: zero. The odds that the Senate could produce 67 votes in favor of online gambling are also zero. You better face the fact that the only real hope for a change in the law is that of a Democratic prez beginning a term in 2009, and that's a looong way off....

Or no funding for the bill....

This bill will cost more than $10mm to write, enforce, train banks, redo the eft/check system, etc...

When they come and ask the finance committee for more money, they will likely be told no.

An unenforced bill is useless. There are 100s of laws that are not enforced but also not overturned.

And I would not be so sure Bush would not sign the bill on a 50% vote. MOst republicans could care less about gambling and after the last elections, understand poker carries a number of votes (Just ask Leach)

That is totally False... He would not risk his Tax Cuts or Funds for the War in Iraq to just Veto a bill that would overturn this if it was a add on. He can't pick and choose what to accept in a bill.... If it was a stand alone bill you are correct, but not a add on

And Sean is right... I don't think Most Republicans give a rats ass about it either, It was just the few that were trying to appeal to the religious right that had a hardon for it and was pushing it... and they got the message in the last election

Thank god someone is trying to do something for us. I am so sick and tired of our rights being taken from us. It sickens me that we have die-hard Republicans as moderators on a gambling website. Dirty and the Devil back a crew that are wanting all of our rights removed from us. Bill Frist and his back door sneaky shit should have been the last straw for anybody who wanted the right to gamble offshore. Unfortunately the far right wing nut jobs want to take every right we have from us. There are countries out there already like that where most of the far right wingers including our moderators could go and flourish nicely. You might want to start with China I believe they have most of the moral and regulation issues already handled for you so you don?t have to think for yourself. Go Barney Frank.<O:p></O:p>

Wow, you guys are living in a dream world. Sean, it makes no difference whether five more cents are allocated for enforcement of the law; the damage has already been done. Pinny isn't about to say, "hmmm, maybe they're not prosecuting as aggressively now, so we'll go back online in the US." As long as the law is on the books and there's any meaningful threat of action from the US, the off-shore community is going to stay scared, as is Neteller.

And Dirty, the prospect that Barney Frank is going to pull a "Frist" and stick a pro-gambling provision in a war appropriations bill is simply not going to happen. Even if it did, it would only make Frank look foolish, and it wouldn't fly. Just because Barney Frank is a bright, rational guy, who wants to right a wrong, doesn't mean that he--or any other lawmaker--brings the level of energy, urgency, or even interest in this the issue that the gambling community would like to see. The bottom line is, for congessmen, this is still a third-rate issue...

And as for your line about "the few [Republicans] that were trying to appeal to the religious right..." The few?? Please, get some help for that denial....

First of all, I am a conservative. I used to be a Republican, mainly because I considered them to be the party of less government, less taxes, and less interference in our personal lives. Sadly, the Republican Party has largely abandoned their base and many conservative principles.

Most of my gambling buddies and I are politically conservative and even attend church regularly. As a church elder, I would always wear my Full Tilt Poker cap to church meetings and never heard a complaint for anyone (I was almost hopeing I would).

Please don't assume that simply because someone is politically conservative and/or attends church that he is in opposition to our interests. It simply is not true.

Barney pisses me off nearly every time he opens his mouth, but I just called his Washington office to convey my support and appreciation for his efforts.

Let's not attack one another because of other political, social, or religious views. In the matter of internet gambling, we should stand united. Our views concerning any other subject must not divide us.

Very nice message, but go tell that to the poker and horse racing guys. Us online sports bettors are the scourge of the world, or so they say. Its not just for us to be united, its for everyone in the political spectrum to be united about government not legislating morality or what one should and shouldn't do without reason.
