Urgent- Call your Representative in Congress and tell them you OPPOSE H.R. 6870- The Payments System Protection Act of 2008

There is a House Financial Services hearing on this bill today.

This bill if enacted into law throws sports betting under the bus. It will accelerate enactment of the UIGEA regulations against sports betting sites.

This bill will make it even harder to deposit and withdraw money from your online sportsbooks.

I have given up on this tilting windmill battle. I wrote the Honorable Feinstien and Boxer over and over not to endorse or vote for the UIGEA from day one. I probably got reponses, canned, that they were against internet gambling, and that it was a plague on the innocent public, written or sent by aides. They backdoored everyone, and attached it to the port security bill at midnoight, when everyone was asleep, at the last minute, so no one could review it, to an anti terrorist bill, that was a shoe in. Only person I'm calling is my local bookmaker. We went right back to square one. But it was one hell of a ride.

Take Action: House Bill Could Gut Gambling Regulations

Two years ago, Congress passed the Unlawful Internet Gambling Enforcement Act (UIGEA). The law gives financial institutions a government go-ahead to block payments to off-shore Internet gambling interests.

And for two years, Rep. Barney Frank, D-Mass., has fought to undo the regulations ? which took family groups nearly a decade to put in place.

In April, Frank's first attempt failed. Now, he's at it again.

H.R. 6870 ? the so-called Payments System Protection Act of 2008 ? purports to clarify UIGEA, but actually would undermine the current regulations. The House Financial Services Committee, which is led by Frank, is scheduled to vote on the bill Tuesday.

"Every citizen should care about this issue because it will bring Las Vegas into every home in America, 24 hours a day, seven days a week," Les Bernal, executive director of Stop Predatory Gambling, told CitizenLink. "Its target audience is teenagers."

According to estimates, Bernal said, problem gamblers between ages 18-25 lose about $30,000 a year. Unleashing Internet gambling would only make the problem worse.

Bernal is heading up a conference at the end of this month to "awaken America?s conscience about predatory gambling, what it means for our democracy and the impact it has on the families and businesses in our communities."

Stop Predatory Gambling, a national grass-roots movement, kicks off Sept. 26-27 near Washington, D.C.

Family advocates can connect with others who are fighting the spread of predatory gambling.

"It offers you the unique ability to share your experiences and knowledge with citizens from across the country," Bernal said, "reminding each of us that we are not alone in this fight and the importance of renewing the passion in our hearts."

A BILL

To ensure that implementation of proposed regulations under subchapter IV of chapter 53 of title 31, United States Code, does not cause harm to the payments system, and for other purposes.
Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the `Payments System Protection Act of 2008'.

SEC. 2. PROHIBITION.

The Secretary of the Treasury and the Board of Governors of the Federal Reserve System, whether acting jointly or separately, may not propose, prescribe, or implement any regulation under subchapter IV of chapter 53 of title 31, United States Code, or otherwise give effect to such subchapter or any such regulation, including the proposed regulations published in the Federal Register on October 4, 2007, except to the extent as any such regulation pertains to wagering of the type that is prohibited (as of the date of the enactment of this Act) under chapter 178 of title 28, United States Code (relating to professional and amateur sports protection) or except as provided in section 3.

SEC. 3. RULEMAKING TO IMPLEMENT SUBCHAPTER ON PROHIBITION ON FUNDING OF UNLAWFUL INTERNET GAMBLING AND DEFINE UNLAWFUL INTERNET GAMBLING.

(a) In General- Notwithstanding section 2, the Secretary of the Treasury and the Board of Governors of the Federal Reserve System, in consultation with the Attorney General, shall jointly develop and implement regulations (which the Secretary and the Board jointly determine to be appropriate), on the record after opportunity for agency hearing involving an administrative law judge or similar official, under subchapter IV of chapter 53 of title 31, United States Code, that shall include a definition of the term `unlawful Internet gambling' for purposes of such subchapter and such regulations, after conducting a full economic impact study of the proposed regulations under chapter 6 of title 5, United States Code (commonly referred to as the `Regulatory Flexibility Act').
(b) Coordination With Prohibition- Upon the effective date of final regulations under subsection (a), section 2 shall cease to apply.

While they run the country into the ground making a select few corporate buddies beyond rich, our families suffer daily, and have great burdens from our ever increasing debt. When the right people line the right pockets, cigarettes and booze remain right there to hurt families even worse, and even gambling away money they can't afford on legal numbers rackets, lottos, they just turn a blind eye. Even shit they fight like drugs are more prevalent and cheaper now then when they started that war of failure.

My country tis of thee, land of lost liberty and going down the proverbial drain. Will congress do anything? Who do you think got us to where we are today?

These are the people who advocated the speculative real estate lending practices of the last half-decade. Now they are bailing everyone out, from the goofball, no-nothing homeowner, to the investment banks, and on to the Freddie Mac and Fannie Mae government agencies. It has been gambling at its best: risk-free. And they all got rich doing it..

But bet on the Salamanders to beat the Gila Monsters? No way. Can't be having gambling going on.

Online sports betting is already illegal, while violating providers are typically prosecuted under the wire act...this proposed BILL does NOTHING to defer such while attempting to achieve clarity as well as protection for financial institutions involved with processing funds.

LEGAL merely means the Government gets its cut of the action through fees and taxes.

ILLEGAL merely means the Government gets its cut of the action through enforcement taxes, fines and confiscations.

The U.S. Government currently employs BOTH Legal & Illegal forms of gaming revenue sourcing.


Why not request elected representatives to issue a BILL which removes ALL Government involvement in the gaming vice trade?

If voters happened to view the recent episode on the History Channel entitled "The Numbers Racket" they'd understand the how and why the Government once outlawed lotteries...then, began sponsoring them as a monopoly.

Moral Governments' don't pimp vices.

Contact my Representatives from the right wing bible thumping state of South Carolina and tell them to make it easier for me to gamble. uh
sure. I wrote letters and made calls out the ass regarding UIGEA, and received two nice form letters outlining the evil and destruction gambling does to our youth. I called both my senators to threaten to vote them out and i could here the chuckle in their voice when one pointed out my letter was the only anti- UIGEA received. No help from the Palmetto state. good luck or is it amen? i get confused on that part.

As for this BS legislature we are SCREWED, I think it will never get changed. And if they want to really be fair about this the government should go after alcohol, casinos, the on-line horse betting. Basically shut down EVERYTHING that could possibly be detrimental to our well being (which could be determine to be pretty much everything). America, the land of the FREE?????????????? Not so sure.

In the House Financial Services Committee on Tuesday, HR 6870, the second version of Barney Frank’s Payments System Protection Act, was passed by a 30-19 vote. After initially being discussed and voted on orally, Republican Congressman Spencer Bachus asked for a roll call vote. The Committee reconvened for the formal vote at 5:00pm ET, eventually passing the legislation comfortably. The measure may now move on to vote on the floor of the House of Representatives.

Frank stated, “We made some changes to [HR 5767] to try to get a majority of the votes as well as a broader agreement. First, it had always been our intention to allow pro sports leagues to opt out. They asked to be opted out of the bill and we’ve done that. The bill will protect sports from being included. It also asks that a list be prepared by the Treasury of what is and isn’t acceptable. You have a right to know what the law is and this would give people the right to know what is and isn’t covered under the UIGEA.”

Not an expert, but it looks like this is very good for poker players, but maybe not so good for sports bettors. I wouldn't be shocked as poker players are more organized (poker players alliance).

Anyone with more insight want to give their opinions?

The key is this: the Wire Act does not make a criminal of the person making the bets, but does of the person accepting the bets (over a wire, while engaged in the business. etc...). So is the act "illegal"? Its a matter of semantics.

What is going on here is not that placing a sports bet somehow becomes a crime with this bill, but that the UIGEA REGULATIONS will, at least at first, only cover sportsbetting. In other words, the person making the bet is still not a criminal, the person or Business accepting the bet is a criminal and the banks and financial service providers will be instructed (by the initial regulations) to block any transaction they can identify as sports bet related.

The Poker people make out if this bill eventually finds its way attached to some appropriations bill next...

money from the poker acct to the sports acct then vice versa.

More importantly, how about calling WSEX and telling them to start a new neteller. They could make a boatload of cash, people respect them, and everyone needs a method to move money (And as far as I Know they arent coming back to the US).

As a side note, I hope Barney's bill passes. As hard as it would be for banks to decide what is a gambling transaction, it will be 100% impossible to distinguish a poker transaction vs a sports transaction. I mean come on, you'll simply transfer to Jamaicapoker, and then transfer from there.

IF poker online gets legalized, its as good as gold.

When they had the 1st financial services committee meeting to talk about the problems with the UIGEA, the feds and the banks both said that in order for the banks to identify illegal payments, the bank customer would have to actually tell them that the payment is from an illegal source like a sportsbook.

"So in order for them to catch you, you have to walk into the bank, hand them the check to deposit, and tell the bank "This check is from a sportsbook"." These exact words (paraphrased) were spoken by Barney Frank, and the feds and bank leaders there at the meeting said, "That is correct sir".

In other words, they admitted it would be impossible to block transactions. They made this very clear.
