That's kind of a silly question. The Constitution is clearly just a celebratory inconvenience nowadays. But for those of you who are government educated, we are going to refer to the Constitution for a moment .. so pay extra attention. You might learn something.
The census is written into the Constitution. In Article I, Section 2 the US Constitution orders that "The actual Enumeration shall be made within three Years after the first Meeting of the Congress of the United States, and within every subsequent Term of ten Years, in such Manner as they shall by Law direct."
Now, a question. Which branch of government is outlined in Article I of the Constitution? Any takes? If you guessed the Legislative branch, then give yourself a pat on the back.
Now, the next question .. if the census is set forth in Article I of the Constitution and not Article II (that would be the Executive branch) .. how did it end up under the Commerce Department in the first place? And how can the Obama White House now claim control? Is this White House power-grab as legal?

Last month, Republican Congressional leaders filed into the Oval Office to meet with President George W. Bush and talk about renewing the controversial USA Patriot Act.


Several provisions of the act, passed in the shell shocked period immediately following the 9/11 terrorist attacks, caused enough anger that liberal groups like the American Civil Liberties Union had joined forces with prominent conservatives like Phyllis Schlafly and Bob Barr to oppose renewal.


GOP leaders told Bush that his hardcore push to renew the more onerous provisions of the act could further alienate conservatives still mad at the President from his botched attempt to nominate White House Counsel Harriet Miers to the Supreme Court.


?I don?t give a goddamn,? Bush retorted. ?I?m the President and the Commander-in-Chief. Do it my way.?


?Mr. President,? one aide in the meeting said. ?There is a valid case that the provisions in this law undermine the Constitution.?


?Stop throwing the Constitution in my face,? Bush screamed back. ?It?s just a goddamned piece of paper!?

Precedent has an unruly way of coming back to bite the hand that feeds it. The "goose" and "gander" cliche is appropriate here. Where were all the Constitution-lovers when the buffoon was goose-stepping all over it?

No, if you read closely, you'll see I merely pointed out that what one President is able to get away with (precedent), is thereby allowed for future Presidents. Sorry if my writings weren't expressed simply enough. . .

No, the market will rebound when the US does. But, until that time, we have a lot of unscrupulous and illegal activity that needs to be rectified and that starts at the top and will work it's way down to all of us.
