reward for the release of any kidnapped person, shall be fined

association, or corporation, any money or other thing of value,
transmits in interstate or foreign commerce any communication
containing any threat to kidnap any person or any threat to injure
the person of another, shall be fined under this title or
imprisoned not more than twenty years, or both.
(c) Whoever transmits in interstate or foreign commerce any
communication containing any threat to kidnap any person or any
threat to injure the person of another, shall be fined under this
title or imprisoned not more than five years, or both.

(d) Whoever, with intent to extort from any person, firm,
association, or corporation, any money or other thing of value,
transmits in interstate or foreign commerce any communication
containing any threat to injure the property or reputation of the
addressee or of another or the reputation of a deceased person or
any threat to accuse the addressee or any other person of a crime,
shall be fined under this title or imprisoned not more than two
years, or both.

Had a bit in the Wall Street Journal today on someone they prosecuted for this very sort of thing. It's only the tease part without a subscription, but you can get the gist from it.

A more egregious case than most, and may have involved a more specialized statute based on threatening the regulators themselves. But, point being, making internet threats is something that they can and will prosecute on. If sentencing exposure of up to five years doesn't get your attention, keep in mind that the basic fine for most federal offenses these days is $250,000.

Just assisting the messenger here. But it never hurts to be basically polite, which generally excludes threats of hunting someone down to (try and) beat them up.

Well, if we're getting into a particular pending case, yeah, you're right, there's a number of reasons why I can't comment, including for one that I'm licensed in Louisiana not out here.

Basically, though, it would be a matter of whether the facts fit the "any threat to injure the person of another" language in the statute under the controlling case law in whichever federal circuit the prosecution was brought. If the person already is being investigated or prosecuted, best advice is for them to get a lawyer, preferably a good one, as this is not the sort of thing where pinching pennies usually leads to a good outcome. (Not defending how costly good representation is, I'm just saying that if it was me in the feds' crosshairs . . . .)

Well, if we're getting into a particular pending case, yeah, you're right, there's a number of reasons why I can't comment, including for one that I'm licensed in Louisiana not out here.

Yeah you don't want someone reporting "Squarepants" to the state bar for unauthorized practice of law.

if you live in another country like saudi arabia or uganda you can send as many threats as you want. nobody is going to do anything to you for sending threats over the internet.
