Is it illegal to be a tout in the US?

Legal but all touts are frauds and washed up car salesman

Never ever pay for a pick because if they were so good they would bet themselves.
 
I do bet myself, and put a lot of work into what I do. Why should other's profit from my hard work, and me not get nothing in return?

I don't think it is illegal, but you may get involved in some other areas by chance which will be very tempting that may break the law.

Good question - why should they? Then stop sharing your picks and it won't be a problem, will it? If you want some cash in return, open up an account at Pinnacle (they're rock-solid and have very high limits) - if you're really good, you should have no problem mopping up, and you'll have the satisfaction of doing it all on your own, without the distractions you'll get from having to supply weekly winners to degenerate gamblers who are relying on you to bail them out from the last losing tout they paid for picks from.

If you are unable to cash consistently, then I'd recommend becoming a tout - that's one of their most consistent attributes, actually - just ask Phil Steele:

Finally, make sure that you never get your selections for an entire season documented beyond reproach - stress your winners and either ignore or simply lie about your losers, should you become a tout - it's incredible how gullible a lot of desperate gamblers are, you know, the ones who are pissing their savings away and lying to their woman about it because they're either embarrassed to be a loser or they're breaking a promise not to gamble. And the FUN of dealing with mostly pissed-off, gullible liars who've taken the bait can't be underestimated. Naturally, always make sure to get paid up front and in a manner that they can't reverse the charge, as on a credit card.

I have been told by a few different people now (US District attorney and a few different FBI agents) that if you are in a state that does not have the a law that makes it illegal to "operate a gambling business" such as Nevada, then you are fine. I was arrested and pled guilty to violating the "wire wager act", but I do really believe that they (us doj) would have had a hard time winning if I (we) had gone to trial. The thing is though that they had some of our employees (Danny B of ESB to name just one) on tape telling people that the games were fixed and by doing so they had a good chance of gaining a fraud conviction. What also made me plead guilty is that many people were afraid (as was I) and they went in right away and made a deal. I thought it would be hard to win against the USA when other people I had worked with would be testifying that they were guilty. The whole investigation started though because the DOJ thought we were recieving "k ick backs" from an offshore sportsbook for intentionally losing for people. (which we were not) SO basically it came down to them having an 18 month investigation and making a very big story in a very small town out of everything and the fact that they had seized most of all of our money and they just wanted to make sure everyone pled guilty and they were able to keep the money.

who is Danny b from ESB? what era was he there? And when you say one of our employees did you work at ESB at some point?

No, I never worked at any offshore place. I was referring to the tout service "players edge/ national sports consultants". We had 2 employees that use to work at ESB, who most people would remember from the radio show that they(esb) use to have, "Danny B and Philly Prince". Danny left Esb and went to work for "Joe Wiz" and later came down to FL and worked for us. I have heard suce horror stories about Dennis A, that it is amazing that somene has not killed him already. (no matter how big he is)

The illegal part starts when you start your site and phone lines and you get bombarded by books,casinos, and poker sites to set up an affiliate program and you realize that you can make more money by getting a cut of the action for getting them sign ups.

P S - don't really have much to contribute on the legality of being a tout. But, I am willing to work in your marketing department with the following proviso.

Players - you win every week or we refund your payment. If that works, let's move the show to a domicile where the lawyer says it is legal - no affiliate stuff.
I'm willing to relocate to Tahoe, etc. you know a trooper - team guy. LOL

Getting off topic here but as a scalper - are you handicapping in order to take leads and gambling on line movement or are these straight up picks you want to gamble on?

Personally, I get zeroed in on moneylines and find it a little hard to change gears and focus on point spreads and totals.
