first someone is going to have to drag NJ into court.

Then NJ case may not be weaker than Delaware since a goofy middle ground ruling, ( You can have bets, but just parlays) seems impossible this time since NJ never took those before.

as far as getting the federal law overturned, the federal gov't isnt allowed to make laws that favor certain states over others.

So why can Harrahs on the Las Vegas strip under federal law take sports bets but one in Atlantic City can't?

That's the case that New Jersey brought before the US Supreme Court, 2 years ago. I thought then the federal law would be overturned and NJ would have sports wagering... BUT the Supreme Court decided not to even hear the case! They don't have to listen to a case if they don't deem it important. I don't get HOW in the hell a case brought by a STATE is not important!!

up until 1975 Major League Baseball and other sports swore they were exempt from the reserve clause.That totally changed.
IMO Computer Bob is totally OVERestimating the NFL and their legally shaky at best side and UNDERestimating Chrisities legally sound position.
Christie has a great chance to succeed and I am quite sure a great legal plan to squash his opposition.
It will be interesting to see how our radical left wing President reacts to this.

My FIRM belief (and I would like to be WRONG), is that when the majority of Billionaire owners of the big 3 sports want it legal, it happens ! To my knowledge as of 2009, they did NOT!

Once New Jersey gets it many other states (especially the large population northeastern states will have to do it too. I don't think it will crush offshore at all. It will siphon money away from them but it will ease a lot of headaches. Do you think sportsbooks are worried that people in Dublin can walk down the street to a Paddy Power betting office and not use them.

Obama is not a radical left-wing President. He's pretty much a centrist Democrat. I don't want to bring politics into this but if you sports bet or play poker then you might want to start by pointing fingers at Senators Frist and Kyle (two Republicans) and their midnight drop of the unpopular UGIEA into the SAFE ACT and then Bush signing it into law as he left office. It was Obama whose Justice Department limited the Wire Act around Christmas of last year which is an important step in paving the way for online poker.

Before this happened I'm sure that Christie's legal staff went through every scenario in how this plays out. And probably had informal consultations with people in Obama's justice department. I'm not saying it's absolutely going to happen. If something or someone stops it (and it's not going to be the NFL) then California will get online poker or some other state will get it. And then with the money coming in then everyone will want a piece. No one in Congress can come out and say rah rah sports bettting whee! it's going to be the states that do it.

Just look at what happened with the lottery.

You're giving the NFL way too much credit. It's not the 1970s. Rozelle is not the commissioner. NFL owners are probably the most unpopular group of wealthy people in the United States. Decades of raping communities to get stadium deals and tax breaks tends to build a lot of ill will. Again, after the labor problem of last year, the bounty scandal, drugs and the concussion lawsuits, do you really think that anyone gives a shit what Goodell thinks.

New Jersey is doing this with the Super Bowl as the prize. I think Goodell has already intimated that he'd pull it. Good luck with that.

As a single example, if Dan Snyder of Redskins comes out in opposition to this you immediately get a huge fan base in the Washington metropolitan area who are going to take your side without going into the details.

That's my understanding also, they are going down a different avenue then delaware did. They are trying to get PASPA overturned and if they do then it will clear the way for them to offer sports betting. Chad Milliman had the guy on his podcast a few months ago who summed up pretty well NJ's case and he sounded very confident that they would win in court. I am sure the NFL will sue for an injunction and then it will be up for the courts to decide.
I think the tide is starting to turn with more states seeing tax revenue. Even here in NY they are already discussing the possibly of adding sports betting. If more states follow suit the NFL will have no choice but to let it happen

I agree 100%. Remember when they were against fantasy sports also they fought hard to fight its growth before they realized how much more popular it made their sport so they embraced it. Maybe they will one day do the same with sports wagering

The mere thought of New Jersey opening up sports books without federal consent is laughable, but I'm all for it. U.S. Marshals could be deployed to shut down the sports books in a raid, much like they do with illegal "pill mills" or any other illicit activity. I'll believe it when I see it.

Generally pill mills don't have a superaggressive, bullying, relentless governor on their side. The majority of the United States wants legalized sports betting and poker and they want to be able to do it on the Internet. Representatives and Senators can't vote for this, even if they want to (that's a whole another thing). You should be praying that US Marshals show up in Atlantic City on Super Bowl Sunday and try and close things down. At that point everyone is going to have to take a side. And then we're not just hostage to a couple of douchebag congressmen who shove unpopular shit into unrelated legislation to fuck over an activity that pretty much the rest of the world gets to do without stressing about it.

LCD, I hope you're right, I just simply don't see it happening. It's been on the table for many years and never was approved anywhere following the passage of the Professional and Amateur Sports Protection Act. During that interim, our country has seen decriminalization of marijuana and same sex marriage in certain parts of the country. We as a society obviously care more about sports betting than gay marriage. :shoot:

I would benefit big time by this happening, but I don't see it happening. It just can't happen unless the Federal law is reversed. I will never see this happen in my lifetime. I just don't see that happening.

There's nothing New Jersey can do about it... it's all talk.

And

The Las Vegas sports books sit empty most of the time. There a couple of times a year where the Sports books bring in customers, but they are not money makers and I have no idea why New Jersey even wants to mess with sports bets. It won't change a thing for the New Jersey Casinos.

But trust me

I would fucking love this, even though it's a little late in my life.

BTW, I think the NFL is stupid for its severe anti-gambling stance, but I'm just going by their track record for pursuing gambling entities for such as ridiculous things like copyright infringements for using the term "SuperBowl" to the suit against Delaware to prevent straight bets and props!

The "Super Bowl" trademark crap was one of the first things that I thought of as well. As I recall, it isn't even just gambling entities they pursue, as I've heard of bars not being able to advertise "Super Bowl parties" and instead have to call it "the Big Game Party."

Delaware tried the same identical thing 3 yrs ago.. Immediately the NFL challenged the State ruling by a Federal appeals board and got the Delaware law overturned. The state was only allowed to have parlay betting on the NFL and NO betting at all on Baseball or Basketball.

I will be BEYOND shocked if NJ gets this!

Delaware had gotten approved for sports betting many moons ago...probably at least 25 yrs. or so. But they were only allowed parlays like they are doing now. If I'm not mistaken, I think Washington state also had some sort of parlay cards for $5, but I guess they dropped it. Whether or not they are still eligible is beyond me. I think that Montana was also approved for some sort of parlays or parlay cards, and now they are getting them back.

The joke of it is, what would the NFL be without sports betting? In the book, "Pass Interference" it was pointed out how the NFL would call up Vegas to find out if there was any "unusual" betting patterns taking place on their games. We all know that Vegas does their own policing of the games to make sure someone isn't doing business without their knowledge.

Even the commish knows that if it wasn't for sports betting that the NFL would never be as popular as it is now. Without gambling, there would probably be no NFL satellite on Direct TV, or the Red Zone on cable. Unless you had an interest on your home team playing, why would you possibly want to see all the other games unless you had money bet on the games or there was a great game being played?

Well, we see from the title of the thread that NJ didn't get sportsbetting this past fall. Its now Christie vs the FEDs, the NFL, the NCAA, et al.

It's irrelevant that the betting doesn't pass state lines. The Congress can regulate interstate commerce, and the term "interstate commerce" in the US Constitution has come to be interpreted to mean almost any commerce, because almost any commerce will have some effect on other states. If this gets anywhere past the planning stage, the NFL (supported by the NCAA) will bring suit to get first a temporary injunction and then a permanent one to halt its implementation.

It interesting that NJ isn't arguing unconstitutionality based on the interstate commerce clause, but a very tenuous argument that the FEDs are requiring NJ to enforce the federal ban which they argue is a unconstitutional abridgment of the state legislature rights.

We shall see how this plays out.

sorry Bob I think you are way off base on this one.... Going to the casino's since day one years ago in NJ ....this is how Jersey operates... they started with having to wear a jacket to enter Resorts International the 1st casino....then 24 hour then the track then poker....this is the last part of the puzzle....the Superbowl will be part of it in New Jersey at met life stadium.....being from NJ for most of my life...easy to read .... the wording was changed as a defense against the NFL and the feds.... save this post of mine.... dinner at michaels at south point if I am wrong ..... the met life superbowl in nj is the deadline 30 days later payable....u will see

So now, just like I predicted, the NFL, NCAA, and DOJ have a permanent injunction prohibiting New Jersey from implementing sports betting.

If and when the 3rd Circuit takes up an appeal, the NFL and DOJ will again be a huge favorite to prevail. At that point, I would guess if there is another appeal, that the Supreme Court won't take it up because there won't be any real judiciable controversy.
