So now, just like I predicted, the NFL, NCAA, and DOJ have a permanent injunction prohibiting New Jersey from implementing sports betting.

If and when the 3rd Circuit takes up an appeal, the NFL and DOJ will again be a huge favorite to prevail. At that point, I would guess if there is another appeal, that the Supreme Court won't take it up because there won't be any real judiciable controversy.
short of an Act of Congress, which will never happen anyway, NJ has managed to to shut the door permanently on ALL states ever getting sports betting now.

Those of us living in reality suspected this would happen. I don't think we see legalized sports gambling outside of Nevada for many years.

new jersey has a different court case......They waited for delaware to screw it up and changed it.

Going to the casino's since day one years ago in NJ ....this is how Jersey operates... they started with having to wear a jacket to enter Resorts International the 1st casino....then 24 hour then the track then poker....this is the last part of the puzzle....the Superbowl will be part of it in New Jersey at met life stadium.....being from NJ for most of my life...easy to read .... the wording was changed as a defense against the NFL and the feds.... save this post of mine.... dinner at michaels at south point if I am wrong ..... the met life superbowl in nj is the deadline 30 days later payable....u will see

The case has cost taxpayers millions of dollars in legal fees and attracted some of the most prominent legal minds in the nation. Two former U.S. solicitors general are representing parties to the case, and Paul Fishman, the U.S. attorney for New Jersey, has argued it personally.

This problem with government and the current legal system right here. Spend millions to possibly make millions for the state.....

The taxpayers lose, the lawyers win

I am still shocked that the entire 3rd Circuit refused to take up the case.

I have read 2 opinions about that fact.

1.---- The 3rd Circuit didn't want to waste their time because they knew the US SC would take the case this summer/fall.

or

2.-----The 3rd Circuit believes New Jersey doesn't stand a chance.

I don't think it has a chance now.

Less than 5% of all cases will be taken by the Supreme Court. I just don't see how this gets a chance.

"This is a disappointing decision, but our fight is not over," he said in a statement.
Lesniak said he plans to introduce a bill today to repeal all laws prohibiting sports betting in the state.
"I expect that the U.S. Justice Department will refrain from intervening, as they have with Colorado and Washington when those states legalized marijuana," he said. "I plan on placing my first bet at Monmouth Racetrack on Sept. 8 for the Giants to beat the spread against the Lions on Monday Night Football."

I would be much more impressed if Mr. Lesniak himself was standing behind the counter taking bets risking federal Wire Act charges instead of just making a bet. Maybe he can convince William Hill's ticket writers who get minimum wage to take the risk.

It should be very interesting if NJ tries to wipe out any regulation and licensing of sports betting entities in order to skirt PASPA.

For example, IMO, to be squeaky clean, they will have to exempt a company or person operating a bookmaking operation from 1. even having a business license, 2. any consumer fraud or deceptive marketing practices regulation and 3. state taxation of profits or any gambling tax or fee since that would require regulation and oversight. Good luck with that NJ.

You need to follow more closely. NJ did try to make it legal. The federal appeals court and SCOTUS shot them down.

Monmouth has already decided as a business decision that its worth the risk.

Unless I missed some state, they all passed laws regulating weed (mostly just medical use of marijuana). Lesniak seems to be proposing the complete opposite, namely dropping any regulation of sports bookmaking.

I'm just confused... are you saying you know more about the situation then the representatives for New Jersey? Unlike before, they seem very adamant about it and Monmouth has even been running trial runs for there new sports betting room over the last couple weeks.

And ComputerBob, you make it seem like they are getting rid of all laws against bookmaking. Not the case at all, only casinos & tracks.

Here is the language in the bill just introduced by state Sen. Ray Lesniak, D-Union County, in the wake of the Supreme Court denying New Jersey’s application to be heard on its sports betting bill:
“AN ACT concerning statutory prohibitions against sports wagering and supplementing Title 5 of the Revised Statutes.
Eliminates statutory prohibitions against sports wagering at racetracks and casinos in New Jersey.
BE IT ENACTED by the Senate and General Assembly of the State of New Jersey:
1. Notwithstanding any other law to the contrary, including, but not limited to, chapter 37 of Title 2C of the New Jersey Statutes, sports wagering conducted at a racetrack or a casino under procedures developed solely by the racetrack or casino shall not be considered unlawful gambling and a person shall not be subject to criminal or civil liability under the laws of this State for participating in, or conducting, sports wagering at a racetrack or a casino as herein provided.
2. This act shall take effect immediately.
STATEMENT
This bill provides that sports wagering conducted at a racetrack or casino under procedures developed solely by the racetrack or casino is not considered unlawful gambling under New Jersey law. Under the bill, a person will not be subject to criminal or civil liability under the laws of this State for participating in, or conducting, sports wagering at a racetrack or a casino.
This bill would conform current law to the rationale expressed by the Solicitor General of the United States in his brief to the United States Supreme Court opposing certiorari in the matter of Christie, et al. v. National Collegiate Athletic Association, et al. On page 11 of his brief, the Solicitor General states that the Professional and Amateur Sports Protection Act (PASPA), 28 U.S.C. 3701 et seq., “does not even obligate New Jersey to leave in place the state-law prohibitions against sports gambling that it had chosen to adopt prior to PASPA’s enactment. To the contrary, New Jersey is free to repeal those prohibitions in whole or in part.”

Yeah, of course, I know Colorado and Washington passed marijuana laws legalizing recreational use. Glad to know that you finally recognize the NJ sports betting situation isn't the same.

It is a fact that Lesniak, as well as several legal analysts and NJ-based journalists, have been wrong at every turn about the prospects of fighting the PASPA with NJ making it legal with regulation. They were all adamant that the courts would allow NJ to regulate and license sports books and they were completely wrong.

OTOH, my analysis has been that it was an uphill struggle and I predicted many of the events that would happen along the way. As a start, just re-read my posts in this thread.

So I guess Monmouth hasn't started taking real bets on sports yet?

They aren't dropping regulation... only allowing sports betting in tracks and casinos that are being run by the tracks and casinos.

This doesn't mean people aren't gonna get arrested for bookmaking in the rest of the state.

How was I wrong? I hadn't seen the proposed language until just now so I only had his general comments to go by.

As it must to avoid violating PASPA, the proposed law allows the racetrack/casino to develop any procedure it likes to implement sports betting. However, the sports leagues may still sue because essentially this is tantamount to licensing only a few businesses to be bookmakers while leaving it unlawful for almost every other business.

It is interesting that Lesniak touted all the consumer protections NJ would have under the previous enabling law with a gaming commission are now are thrown out under the new regime.

Its still regulated in 99% of the state. I'm sure will they still make there usual every-6-month major arrest to a mafia figure taking bets like they do now.
