Smoking pot shouldn't be a crime. Or the public's business.

Dear America,

I take it back. I don?t apologize.

Because you know what? It?s none of your goddamned business. I work my ass off 10 months a year. It?s that hard work that gave you all those gooey feelings of patriotism last summer. If during my brief window of down time I want to relax, enjoy myself, and partake of a substance that?s a hell of a lot less bad for me than alcohol, tobacco, or, frankly, most of the prescription drugs most of you are taking, well, you can spare me the lecture.

I put myself through hell. I make my body do things nature never really intended us to endure. All world-class athletes do. We do it because you love to watch us push ourselves as far as we can possibly go. Some of us get hurt. Sometimes permanently. You?re watching the Super Bowl tonight. You?re watching 300 pound men smash each while running at full speed, in full pads. You know what the average life expectancy of an NFL player is? Fifty-five. That?s about 20 years shorter than your average non-NFL player. Yet you watch. And cheer. And you jump up spill your beer when a linebacker lays out a wide receiver on a crossing route across the middle. The harder he gets hit, the louder and more enthusiastically you scream.

Yet you all get bent out of shape when Ricky Williams, or I, or Josh Howard smoke a little dope to relax. Why? Because the idiots you?ve elected to make your laws have, without a shred of evidence, beat it into your head that smoking marijuana is something akin to drinking antifreeze, and done only by dirty hippies and sex offenders.

You?ll have to pardon my cynicism. But I call bullshit. You don?t give a damn about my health. You just get a voyeuristic thrill from watching an elite athlete fall from grace?all the better if you get to exercise a little moral righteousness in the process. And it?s hypocritical righteousness at that, given that 40 percent of you have tried pot at least once in your lives.

Here?s a crazy thought: If I can smoke a little dope and go on to win 14 Olympic gold medals, maybe pot smokers aren?t doomed to lives of couch surfing and video games, as our moronic government would have us believe. In fact, the list of successful pot smokers includes not just world class athletes like me, Howard, Williams, and others, it includes Nobel Prize winners, Pulitzer Prize winners, the last three U.S. presidents, several Supreme Court justices, and luminaries and success stories from all sectors of business and the arts, sciences, and humanities.

So go ahead. Ban me from the next Olympics. Yank my endorsement deals. Stick your collective noses in the air and get all indignant on me. While you?re at it, keep arresting cancer and AIDS patients who dare to smoke the stuff because it deadens their pain, or enables them to eat. Keep sending in goon squads to kick down doors and shoot little old ladies, maim innocent toddlers, handcuff elderly post-polio patients to their beds at gunpoint, and slaughter the family pet.

Tell you what. I?ll make you a deal. I?ll apologize for smoking pot when every politician who ever did drugs and then voted to uphold or strengthen the drug laws marches his ass off to the nearest federal prison to serve out the sentence he wants to impose on everyone else for committing the same crimes he committed. I?ll apologize when the sons, daughters, and nephews of powerful politicians who get caught possessing or dealing drugs in the frat house or prep school get the same treatment as the no-name, probably black kid caught on the corner or the front stoop doing the same thing.

Until then, I for one will have none of it. I smoked pot. I liked it. I?ll probably do it again. I refuse to apologize for it, because by apologizing I help perpetuate this stupid lie, this idea that what someone puts into his own body on his own time is any of the government?s damned business. Or any of yours. I?m not going to bend over and allow myself to be propaganda for this wasteful, ridiculous, immoral war.

Go ahead and tear me down if you like. But let?s see you rationalize in your next lame ONDCP commercial how the greatest motherfucking swimmer the world has ever seen...is also a proud pot smoker.

One thing I always wondered: How would you prove it if you suspect a person of driving under the influence of pot? I mean, you'd have to piss test them...and even then, pot stays in your system long after the high wears off. So, you really can't prove someone is actually "under the influence"...that I know of. Is there a way? I mean other than waving a bag of chips in front of them and seeing if the lunge at it. :+textinb3

You would prove intoxication the same way most driving while intoxicated cases are proved up now: by officer testimony regarding loss of mental or physical faculties. I don't know the actual numbers, but I'd be willing to guess that less than half of those arrested for suspicion of driving while intoxicated actually blow on the breath machine. However, I'm not sure that marijuana leads to the loss of mental or physical faculties in the same manner that ethyl alcohol does. Just as in alcohol cases, the crime is not the consumption, but in the operation of a motor vehicle while intoxicated.

i got pulled over saturday on my way home from the casino. Literally just got done smoking when he pulled me over...He thought i was drunk, but i wasn't so he let me go.

It was funny because he was just so confused by me :+clueless...

As for the Phelps situation, he's paid by the same hypocrites who feel his image means something that's why hes being paid, right or wrong he knows the deal.... so if he wants to get high fine, just give the money back and toke away.

Pot may not be as bad as some make it out to be, however the stats for smoking overall cannot be denied.

There are certainly much worse things he could have done, but he is being paid to carry himself in a certain light....I'm sure if his endorsement deals hinged upon him taking drug tests he'd stay pot free....so he has a choice, give back the 50 million or don't get caught with your mouth on a bong .

I'm all for legalization, but the problem here will be the issue of driving as there is no present objective test to determine if someone is under the influence of marijuana. If they can make such a test, legalization will be much easier. Many will say...."hey I drive better stoned"....it simply isn't true. The question is if more people would drive stoned if it were legal than already drive stoned...

Same thing happened to me in college.. He was sure I was drunk, but I hadnt had a sip, and had hit that bong like a mofo... The cop was so pissed at me for not being drunk he told me he could whip my ass :LMAO.. i found that an odd thing to say, but i just shook my head (stoned like a "Awakenings" patients, lol)

You're right. I have driven many times stoned, especially on long trips. It doesnt make me a better driver, reaction times are a bit slower, and you tend to daydream sometimes. But I actually slowed down stoned and was extra careful not to take any risks.. So, all in all, it was sort of an odd type trade off.

BTW I may smoke a J once or twice a year now.. this was more like 8 years ago etc..

I'm sure they are 10xs worse...smoking is something that affects others because the smoke travels all around the smoker and everyone has to breathe it in, the smell is disgusting , it looks disgusting, and the side effects are very severe....most who smoke end up quitting because they eventually realize how much damage it's causing.

Pot smells awful IMO, if they do legalize it, it should only be allowed within a persons home, why should non smokers be forced to smell it?

I just don't wanna smell the stuff:suit:

But if he pulls me out of my car and asks me to walk a straight line, then I trip...how the hell does he know I'm not just clumsy? And I'm tellin' you right now...dead sober...I couldn't recite the alphabet backwards. So I guess my questions is: If the officer doesn't know me, how does he know I've lost anything mentally or physically?

Right, and I agree. Personally, I think being stoned makes me a more careful driver (and a hell of a lot more calm), but to each their own. BUT, it should be against the law to drive under the influence of any mood altering drug...even some that doctors hand out like candy.

Dude, I will never forget the time one of my girls got pulled over with 3 of us in the car. We had TWO bowls going only seconds earlier and all the windows were up because it was raining. We didn't even get a ticket...and we ran a damn red light! There's no way he couldn't smell the shit....but there were four 18 year-old girls, soaking wet and dressed for the beach...you do the math.

Oh, and yes, that's me. I guess stoners aren't all fat, lazy slobs!

Hey, you don't know that, you're not in my car! I really do drive better after a hit or two. Maybe not full-on stoned...but I have driving anxiety. I'm way to high strung for my own good on the road. One or two takes the edge off and allows me to focus on the road instead of my fear. That said....sometimes I'm so focused on the road I forget where I was going. :doh1

I try to stay out of the way and in designated areas when I want a cigarette. If you walk through my area, it's not my problem. But, I'm not getting into this here. I just wish non-smokers would learn to treat us like human beings.

I hate this argument with all kind of smoking. My response: Tough shit. Build yourself a bridge and get the fuck over it. I didn't want to smell the lady who always went into the gas station stinking of cat pee. And I do mean STINKING. I could always smell her from the parking lot. Or how about the guy that refuses to wear deoderant behind the counter....or the other old lady who I swear made her clothes out of mothballs. And there's plenty of perfumes I can't stand, too. Oh, and I'm not a big fan of the way the beach smells at low tide. You don't hear me crying about it.

All DWI/DUI statutes prohibit the operation of a motor while intoxicated, no matter what the intoxicant is. I've seen many, many DWI convictions based on narcotics intoxication, or a combination of narcotics and alcohol.

Believe it or not, the looming financial crisis will assist in the legalization effort. As states' budgets come under increasing pressure, the money spent on corrections will tighten up. One BIG way to save on corrections costs is to stop locking up marijuana users. Then consider the taxation angle, and the fact of generational change. The atmosphere regarding marijuana is changing.

It was funny later, but I was terrified. All of my friends got the giggles as he was walking up to the car while I thought I was going to pee on the hot bowl I just had to shove down my shorts. :blink:

Oh, and for the record, she didn't run the light because she was stoned. That light is notorious for going almost right from green to red...with a brief flash of yellow in between. When she saw the yellow, she tried to stop, but it had just started raining, so she skidded a little. Rather than screach to a halt, she just tried to make it through. She did not, however, see the state trooper...none of us did. THAT you can blame on the pot. :LMAO

I'm all for legalization, but the problem here will be the issue of driving as there is no present objective test to determine if someone is under the influence of marijuana. If they can make such a test, legalization will be much easier. Many will say...."hey I drive better stoned"....it simply isn't true. The question is if more people would drive stoned if it were legal than already drive stoned...

Use the same tests that are used now. My side of the bar thinks the Field Sobriety Tests are voodoo and hogwash anyway, but the state keeps getting convictions based on officer testimony regarding the performance on the FSTs. The point is, I'm not sure that marijuana "intoxication" (if that's what you want to call it), causes one to lose the normal use of their mental or physical faculties to the point where they cannot operate a motor vehicle safely. I don't smoke it, so I'm probably not the best authority on the matter.

BUT, I really do have an inner ear problem. There are days that I couldn't stand on one leg if you paid me. As I said before, I have a pretty bad driving anxiety problem. The scenario of a cop thinking I'm drunk when I'm not is one that I run over and over in my head. I don't know why, but it's a big worry of mine. Plus, cops make me absurdly nervous. I mean, if one pulls out behind me...I WILL go into a panick attack....then start panicking more when I realize if I pull over, he'll probably stop to ask why...and I'll definitely look strung out on something. And I'm talking about when I have absolutely nothing to worry about. Anywho, that's why I was asking....just trying to calm my own fear...and failing. :doh1


I wish more people realized that driving under the infuence of perscription drugs is illegal. I know some peole so pumped full of meds that they should even be on a scooter. :blink:

EVERYBODY gets nervous in a traffic stop. If you have been drinking, DON'T BLOW, DON'T BLOW, did I mention "don't blow?" If it proceeds to the point of performing sobriety tests, you are probably already going to be arrested, take the ride and lawyer up later. Caveat: the Horizontal Gaze Nystagmus test sometimes will satisfy the officer that you're not intoxicated and it will end right there. The other tests and a long Q & A session with the cop at the scene is normally just providing evidence against yourself.
