Can Bodog send unpaid balance to collection agency?

Have not been with bodog since bank withdrawls were shutdown. Checked old e-mail account that bodog has of mine. The e-mail say's I had a deposit that had not cleared bank when transfer system shutdown and are threating to send to third party. Just wondering what the hell... thanks for any reply's

If they do send it to collections tell them to go to hell unless they want to meet you in court. They'll probably back off and there is a statute of limitations on debts; how long depends on the state in which you live.

Well it is a debt that you owe. You bet the money and lost the bets! PAY THE MONEY!

Dont be a thief! That is basically what you will be by not paying the money. You know that you owe it and took advantage of them

paying the money is the RIGHT thing to do, however, not sure they will be able to force you to....the only thing a collection agency can do is threaten to go to court, garnish wages, etc.....dont think a court can uphold an "illegal contract", and processing of these payments in the u.s now is illegal....so not sure how that unfolds....but paying it is the right thing to do..

Now that being said, i wouldnt be forced into paying any ridiculous "fees" that they always like to add to those things...because i think in this case, you have the upper hand...

They will not send it to a collection agency - they may threaten to but wont. Gambling debts are unenforcible - if you went to vegas and stiffed them on your markers they couldnt do anything about it either. What they will do is ban you and most likely put your name on a list of known stiffs to other offshore sites. How much are you talking about? if you lost the money fair and square you should pay up.

Mr. Merlin, your info is quite misleading: For years now, casinos in both Nevada and New Jersey have been filing civil suits against gamblers with unpaid markers. In fact, back in 2001, one gambler who tried to skip out on his marker was criminally prosecuted, basically under a "bad check" law. The guy was convicted, and appealed his case, arguing that he had the equivalent of credit card debt, but had not committed any fraud upon the casino. The 9th Circuit Court of Appeals ruled against the gambler, saying he was criminally liable and could be thrown in jail. Domestically, casinos take unpaid markers seriously, and will go after you aggressively. To say that such contracts (in the US) are unenforceable is to confuse gambling in Vegas--in which all contracts are legal, binding, and regulated--with internet gambling with a company in Antigua, which is a "criminal enterprise."

True, it is likely that the long arm of Bodog cannot reach a player in the US. It is less clear, however, whether Bodog could successfully wreck his credit rating.

You are right. Nevada quietly changed their laws on markers a few years ago. Markers are now treated as bad checks and therefore enforcable in other states whereas before they were not. Right after that I noticed more and more offers from casinos for credit(and in higher amounts) than ever before. They know now they have real leverage when they can bring criminal charges if you don't pay even if you never come back to the Carny State.
Don't apply for a marker with any less seriousness than you would write a check back home! FWIW.

The right thing to do is to pay the debt. However there is no legal recourse for Bodog to wreck your credit. It is not a legal debt since the transaction is considered illegal. You can't compare your situation with a debt with a legal Nevada casino. If you owed your corner bookie money and he sued you what do you think the court would do? Bottom line....it is not a valid debt in my opinion.

I'm not for not paying debts, but if a collection agency contacts you ask them to validate the debt and provide the contract showing you owe it. When they can not, if they report it to your credit reports, they have broken the FDCPA. I had an AMex stolen about 8 years ago, and know every credit law there is...

JeffR and the others are correct, an unpaid marker to a NV casino can send your ass to jail. I know of a guy that owed a casino a mid 5 figures marker and he didn't pay it due to a dispute. He was pulled over about a year later and there was a warrant from NV for his arrest. He spent 10 days in county jail until he got the marker paid and the warrant cleared. And they weren't in a hurry to due the paperwork in NV either.

You read that wrong Archie, he said he is NOT FOR "not paying debts" double neg. which means he IS for paying debts...i read it wrong first time too....
