The WTO final ruling on the appeal is due out tomorrow. You can read about the case, dates, etc at wto.gov

Question (JC are you out there) - Can the US appeal again, or is this the end?

Also, it should be noted, the US will not be able to pay Antigua off. In most cases, that is what the US does (Tree disputes with Canada, etc). In this case, this would not work. If the US offers Antigua $100million or whatever to go away, at least 50 other nations would file similar suits about online gambling. There are lots of poor nations that host servers and would be happy to get settlements.

The US will either have to decide to comply and change laws or simply refuse to comply.

Antigua can't really do anything even if the U.S. breaks the law. Antigua can put punitary tariffs on U.S. goods, but considering that Antigua has the population of a small town, the U.S. isn't sweating any ruling.

1. If the WTO gives Antigua the right to not follow US trademarks/patents. Even Antigua alone would not bother the US, but if Antigua is given this right, you can count on Panama, Caracao, CR, El Salvador, BArbados, Grenada, Nicauragua, Guatamalua, etc etc etc to appeal to the WTO for similar rights due to losses from online wagering.

2. If the US ignores the ruling, every time they ask China or someone else to comply with something the WTO rules, that country is just gonna say, you comply first.

Man, that would be awesome to put some pressure on the U.S. to stop their holy war against gambling. Let's see what Antigua will do if they win their case.

The US use the WTO at their leisure and when it is convenient for them.

Case in point is them ignoring this case against Antigua but conveniently cite the WTO agreement in order to force Russia to take action against an MP3 website based in that country that is ignoring copyright laws. I think it was called allofmp3.com or something...

I wish I had the press release because the hypocrytical US actually demand Russia 'honor' the WTO!!!

I think you are getting closer Sean. Still #1 is off, every country has to go through this same process to get its "rights". A lawyer confirmed to me you can't just piggyback off of another ruling, you have to go through it step by step. Although its nice to know there is precedent and you probably will get a favorable ruling. Besides on your list after CR none of those countries has any stake in this business.

They may have to file the same suit, but I bet a country cant appeal the same ruling over and over and over. That would make no sense.

If the US was thinking about scrapping the anti gambling/banking law, this would be the prime opportunity to do it. Gamblers get their way and the politicians who favored the legislation will be able to save face with their core voters.

It wouldn't surprise me if the US gov knew this day was coming, found out who the best book is, asked pinnacle to leave the market, so they could be the first regulated one invited back. If you are going to comply with the WTO, what better way to do it than invite the book that previously complied with your request...

and as a side product, you knock out the largest transferrer so that you can set up the next one and regulate it like a bank... or just let them start up again under regulation.

Probably far fetched, but if Pinnacle was public right now, I'd buy some.

They had their chance, but blew it. A 15% tax rate on online gambling is going to attract virtually no one. All these UK bookmakers will maintain offices in Gibraltar, Isle of Man, Alderney, and Malta where they pay effectively 1% or less tax.

Listen you guys are "barking" up the wrong steps. THE ONLY WAY FOR THEM TO LISTEN is to hurt them where it hurts. We have the power to do anything in America. If we started a campaign nationwide to boycott every racetrack, ballpark, casino, and not turn on one NBA playoff game or BB game on our TV sets for just ONE MONTH.....asking the government to restore our rights to do with our leisure time as we choose.......they listen. Total committment for one single month.

Good luck. You'd need someone with serious money to start the campaign. Now if someone like WSEX or Bodog or whoever wanted to run commercials for a month asking people not to watch sports for 30 days, then you might get somewhere...

There were multiple seats that were decided by a few hundred/thousand votes, and angry voters could have made the difference there.

Seems like only Antigua is taking the U.S. head on over gambling. I really like their fighting spirit and their heart, but their country is too small. They have a population under 100,000. More countries need to take on the U.S. using the WTO. Is there a reason why only Antigua is doing this? If Britain did this, then the U.S. would be in a sh**load of trouble.

I'd like to be optimistic that this WTO stuff will actually amount to something, but I think the US will either pay them off to drop it, or threaten/bully them and they'll drop it...but I hope I'm wrong...

Jim Leach was apparently solid in his district. In 2004 John Kerry got 59% of the votes in Leach's district, while Leach won easily 59% to 39%.

Clearly much of the shift had to do with the war, particularly with the University of Iowa in his district.

But Leach only lost 107,097 to 101,386, or by 5,711. So, if his stance on the gambling bill only caused 2400 people to change their vote (about 1%), then it cost him the election.

In fact, the county with the University of Iowa made up more than the 5,711. You don't reckon there are some college students who gamble online?

The sad part is that there wasn't any serious discussion on the national level of this as a potential factor.
