Senators John Rockefeller (D-W. Va.) and Olympia Snowe (R-Maine) think so. On Wednesday[4/1/2009] they introduced a bill to establish the Office of the National Cybersecurity Advisor?an arm of the executive branch that would have vast power to monitor and control Internet traffic to protect against threats to critical cyber infrastructure. That broad power is rattling some civil libertarians.

e Cybersecurity Act of 2009 (PDF) gives the president the ability to "declare a cybersecurity emergency" and shut down or limit Internet traffic in any "critical" information network "in the interest of national security." The bill does not define a critical information network or a cybersecurity emergency. That definition would be left to the president.
The bill doesn't only add to the power of the president. It also grants the Secretary of Commerce "access to all relevant data concerning [critical] networks without regard to any provision of law, regulation, rule, or policy restricting such access." This means he or she can monitor or access any data on private or public networks without regard to privacy laws.

Rockefeller made cybersecurity one of his key issues as a member of the Senate intelligence committee, which he chaired until last year. He now heads the Committee on Commerce, Science and Transportation, which will take up this bill.
"We must protect our critical infrastructure at all costs?from our water to our electricity, to banking, traffic lights and electronic health records?the list goes on," Rockefeller said in a statement. Snowe echoed her colleague, saying, "if we fail to take swift action, we, regrettably, risk a cyber-Katrina."

But the wide powers outlined in the Rockefeller-Snowe legislation has at least one Internet advocacy group worried. "The cybersecurity threat is real," says Leslie Harris, head of the Center for Democracy and Technology (CDT), "but such a drastic federal intervention in private communications technology and networks could harm both security and privacy."

The bill could undermine the Electronic Communications Privacy Act (ECPA), says CDT senior counsel Greg Nojeim. That law, enacted in the mid '80s, requires law enforcement seek a warrant before tapping in to data transmissions between computers.
"It's an incredibly broad authority," Nojeim says, pointing out that existing privacy laws "could fall to this authority."

Jennifer Granick, civil liberties director at the Electronic Frontier Foundation, says that granting such power to the Commerce secretary could actually cause networks to be less safe. When one person can access all information on a network, "it makes it more vulnerable to intruders," Granick says. "You've basically established a path for the bad guys to skip down."
The bill's scope, she says, is "contrary to what the Constitution promises us." That's because of the impact it could have on Internet users' privacy rights: If the Commerce Department uncovers evidence of illegal activity when accessing "critical" networks, that information could be used against a potential defendant, even if the department never had the intent to find incriminating evidence. And this might violate the Constitutional protection against searches without cause.

"Once information is accessed, it can be used for whatever purpose, no matter the original reason for accessing something," Granick says. "Who's interested in this [bill]? Law enforcement and people in the security industry who want to ensure more government dollars go to them."
Nojeim, though, thinks it's possible the bill's powers could be trimmed as it moves through Congress. "We will be working with them to clarify just what is needed and how to accomplish that," he says. "We're hopeful that some of the very broad powers that the bill would confer won't be included."

of Obama's Secrecy/Immunity Claims

-Several weeks ago, I noted that unlike the Right -- which turned itself into a virtual cult of uncritical reverence for George W. Bush especially during the first several years of his administration -- large numbers of Bush critics have been admirably willing to criticize Obama when he embraces the very policies that prompted so much anger and controversy during the Bush years. Last night, Keith Olbermann -- who has undoubtedly been one of the most swooning and often-uncritical admirers of Barack Obama of anyone in the country (behavior for which I rather harshly criticized him in the past) -- devoted the first two segments of his show to emphatically lambasting Obama and Eric Holder's DOJ for the story I wrote about on Monday: namely, the Obama administration's use of the radical Bush/Cheney state secrets doctrine and -- worse still -- a brand new claim of "sovereign immunity" to insist that courts lack the authority to decide whether the Bush administration broke the law in illegally spying on Americans.

The fact that Keith Olbermann, of all people, spent the first ten minutes of his show attacking Obama for replicating (and, in this instance, actually surpassing) some of the worst Bush/Cheney abuses of executive power and secrecy claims reflects just how extreme is the conduct of the Obama DOJ here.
Just as revealingly, the top recommended Kos diary today (voted by the compulsively pro-Obama Kos readership) is one devoted to attacking Obama for his embrace of Bush/Cheney secrecy and immunity doctrines (and promoting the Olbermann clips).

When it was Bush offering security in trade for constituional freedoms the criticism was warranted,as it should be now when Obama's continuing and extending the power of the state over its citizens.

Beneath his seemingly boundless charisma and charm, Barack Obama has always been an utterly ruthless politician. On the matter of universal single payer health care, Obama and his minions offer the deliberately misleading rhetoric of so-called ?affordable health care? which is not Universal single payer health care and still serves the financial interests first and foremost of the bloated and blood sucking insurance companies and their Wall Street accomplices. Universal single payer health care for everyday people is, and must be treated as, a human right, not some capitalist market commodity from which money is to be made or profit gained. On this matter of health care Obama and both the Democrat and Republican Parties (i.e. the Republicrats) are hustling the peoples of this nation.

5. Despite his misleading rhetoric to the contrary, Obama has set out to break the back of organized labor in a way that would have made Ronald Reagan green with envy. Again, this should come as no surprise as back in 2008, Obama made his strong ?admiration? for the late Ronald Reagan known. This is the same anti-union Ronald Reagan who is remembered for, among other things, despising poor and working class people and for having utilized the military to neutralize the legitimate organizing / labor rights and aspirations of <ST1:pLACE w:st="on"><ST1:COUNTRY-REGION w:st="on">U.S.</ST1:COUNTRY-REGION> civilian air traffic controllers, etc.
One should not be surprised at being bitten by the proverbial snake.

Barack wasnt my 1st or 2nd choice

This country had no other options as McCain backed up by Palin was
as weak of card as maybe ever in our lifetime considering McCain's
health and age and the total lost fog the Palin lives in

option of BO vs McCain was a no brainer ....

I have been often to, I guess, the mother ship in New York City, but its good to have an outpost of the Council right here down the street from the State Department. We get a lot of advice from the Council, so this will mean I wont have as far to go to be told what we should be doing and how we should think about the future.

This summer, on a remote stretch of desert in central Utah, the National Security Agency will begin work on a massive, 1 million-square-foot data warehouse. Costing more than $1.5 billion, the highly secret facility is designed to house upward of trillions of intercepted phone calls, e-mail messages, Internet searches and other communications intercepted by the agency as part of its expansive eavesdropping operations. The NSA is also completing work on another data warehouse, this one in San Antonio, Texas, which will be nearly the size of the Alamodome.

The need for such extraordinary data storage capacity stems in part from the Bush administration's decision to open the NSA's surveillance floodgates following the 9/11 attacks. According to a recently released Inspectors General report, some of the NSA's operations -- such as spying on American citizens without warrants -- were so questionable, if not illegal, that they nearly caused the resignations of the most senior officials of both the FBI and the Justice Department.

Last July[2008], many of those surveillance techniques were codified into law as part of the Foreign Intelligence Surveillance Amendments Act (FAA). In fact, according to the Inspectors General report, "this legislation gave the government even broader authority to intercept international communications" than the warrantless surveillance operations had. Yet despite this increased power, congressional oversight committees have recently discovered that the agency has been over-collecting on the domestic communications of Americans, thus even exceeding the excessive reach granted them by the FAA.


Among the most striking discoveries to come out of the Inspectors General report was that, despite the enormous expansion of the NSA's capabilities, including turning its giant ear inward for the first time in three decades, no one could point to any significant counterterrorism success. Instead, it warned that while the agency had little difficulty collecting vast amounts of data, the trouble was analyzing it all. It was a problem akin to Jorge Luis Borges' "Library of Babel," a place where the collection of information is both infinite and at the same time monstrous, where the entire world's knowledge is stored, but not a single word understood. In this "labyrinth of letters," Borges wrote, "there are leagues of senseless cacophonies, verbal jumbles and incoherences." In addition to the civil liberties and constitutional defects in the new surveillance law, another compelling argument against it is that it only increases the amount of "senseless cacophonies" in America's Library of Babel.

...remember that the internet was created by the military (it was originally called Arpanet - ?Arpa? standing for ?Advanced Research Projects Agency?).
And that a former CIA officer says that seed money from the the CIA helped launch Google.
And that the security services ? especially the NSA ? are tracking everything we do on the net. Indeed, as I?ve previously written:
A governmental unit operating in secret and with no oversight whatsoever is gathering massive amounts of data on every American and running artificial intelligence software to predict each American?s behavior, including ?what the target will do, where the target will go, who it will turn to for help??
The Pentagon is also running an AI program to see how people will react to propaganda and to government-inflicted terror. The program is called Sentient World Simulation:
?U.S defense, intel and homeland security officials are constructing a parallel world, on a computer, which the agencies will use to test propaganda messages and military strategies.
Called the Sentient World Simulation, the program uses AI routines based upon the psychological theories of Marty Seligman, among others. (Seligman introduced the theory of ?learned helplessness? in the 1960s, after shocking beagles until they cowered, urinating, on the bottom of their cages.)

Yank a country?s water supply. Stage a military coup. SWS will tell you what happens next.
The sim will feature an AR avatar for each person in the real world, based upon data collected about us from government records and the internet.?
So we are using the web to spread the truth.

But the powers-that-be may also be using the web to let us blow off eSteam ? venting our frustrations in a virtual environment, instead of actually doing something in the real world, like surrounding Congress in a peaceful protest, or taking other action to challenge those in power.

And they are studying our every moves, to study not only what we?re doing, but to be able to predict how best to manipulate us.
The commonly-accepted wisdom of bloggers (such as me) is that we are slowly but surely winning the battle to spread the truth.
After all, the web has now become the most popular source for news.
And the alternative media has sometimes pounded on stories so hard that the corporate news was forced to cover them, and the politicians and business elites were forced to scramble to explain away their actions.

This is why there is still unlimited, unfettered access to freedom of speech on the internet. Because the powers that be (PTB) know that people feel better about the situation just openly talking about the issues. The internet to them is not a threat, but it is our crutch. People complain, explain, disdain, sustain and act in pain on the internet about a myriad of problems.
AND THEY FEEL BETTER. So much better, that they do absolutely nothing else. Well, most do anyway.

I don?t know what to think anymore. Has anyone ever read the Berlin Stories by Christopher Isherwood? They take place in Germany right before the total Nazi takeover and one character is an ardent commie who posts bills and writes pamphlets and rants all over the place. He is happy playing his game of bad ass rebel. Then ?they? take him away to die, in earnest. All his friends that can scatter do so. That whole section sticks in my head whenever I read some of the comments on this and other websites. I know I?m on a list somewhere and I don?t give a shit anymore. The question is,?what do we DO? What will be our final stand?? Sorry. Maybe it?s sunspots. I?m just so discouraged lately.

I would argue that instead of spreading information, the internet does the opposite ? it contains the spread of information, just to those who choose to seek it out, it distorts the perception of the value of such information because it isolates communication of this information only to parties aware of it or seeking to be made aware of it and creates the illusion that spreading information actually acomplishes something else, other than communication of sought after or expected information by a defined group. ?Preaching to a choir?, if you will.
I grew up in old Soviet Union,in the late 60?s and early 70?s ? during time of my childhood, the Soviet government subsidized many different forms of recreation. Leisure travel (within Soviet Union), sports, arts / humanities, etc. One could argue that besides the social value of this, the other purpose was to simply take up people?s free time with activities that would prevent them from spending too much of their free time thinking about or participating in politics. Internet provides a much cheaper solution. Case in point ? I just wasted 5 minutes typing this and you wasted 2 minutes reading it. What did this actually acomplish?

Keith Olbermann openly lamented the fact that Cheney wasn't killed on one of his visits to Iraq. The Huffington Post (among other far less mainstream outlets) touted revolution and the violent overthrow of the government.
