Obama Regulation Czar Advocated Removing People?s Organs Without Explicit Consent

(CNSNews.com) ? Cass Sunstein, President Barack Obama?s nominee to head the Office of Information and Regulatory Affairs (OIRA), has advocated a policy under which the government would ?presume? someone has consented to having his or her organs removed for transplantation into someone else when they die unless that person has explicitly indicated that his or her organs should not be taken.

Under such a policy, hospitals would harvest organs from people who never gave permission for this to be done.

Outlined in the 2008 book ?Nudge: Improving Decisions About Health, Wealth, and Happiness,? Sunstein and co-author Richard H. Thaler argued that the main reason that more people do not donate their organs is because they are required to choose donation.

Sunstein and Thaler pointed out that doctors often must ask the deceased?s family members whether or not their dead relative would have wanted to donate his organs. These family members usually err on the side of caution and refuse to donate their loved one?s organs.

?The major obstacle to increasing [organ] donations is the need to get the consent of surviving family members,? said Sunstein and Thaler.

This problem could be remedied if governments changed the laws for organ donation, they said. Currently, unless a patient has explicitly chosen to be an organ donor, either on his driver?s license or with a donor card, the doctors assume that the person did not want to donate and therefore do not harvest his organs. Thaler and Sunstein called this ?explicit consent.?

They argued that this could be remedied if government turned the law around and assumed that, unless people explicitly choose not to, then they want to donate their organs ? a doctrine they call ?presumed consent.?

?Presumed consent preserves freedom of choice, but it is different from explicit consent because it shifts the default rule. Under this policy, all citizens would be presumed to be consenting donors, but they would have the opportunity to register their unwillingness to donate,? they explained.

The difference between explicit and presumed consent is that under presumed consent, many more people ?choose? to be organ donors. Sunstein and Thaler noted that in a 2003 study only 42 percent of people actively chose to be organ donors, while only 18 percent actively opted out when their consent was presumed.

In cases where the deceased?s wishes are unclear, Sunstein and Thaler argued that a ?presumed consent? system would make it easier for doctors to convince families to donate their loved one?s organs.

Citing a 2006 study, Thaler and Sunstein wrote: ?The next of kin can be approached quite differently when the decedent?s silence is presumed to indicate a decision to donate rather than when it is presumed to indicate a decision not to donate. This shift may make it easier for the family to accept organ donation.?

The problem of the deceased?s family is only one issue, Sunstein and Thaler said, admitting that turning the idea of choice on its head will invariably run into major political problems, but these are problems they say the government can solve through a system of ?mandated choice.?

?Another [problem] is that it is a hard sell politically,? wrote Sunstein and Thaler. ?More than a few people object to the idea of ?presuming? anything when it comes to such a sensitive matter. For these reasons we think that the best choice architecture for organ donations is mandated choice.?

Mandated choice is a process where government forces you to make a decision ? in this case, whether to opt out of being an organ donor to get something you need, such as a driver?s license.

?With mandated choice, renewal of your driver?s license would be accompanied by a requirement that you check a box stating your organ donation preferences,? the authors stated. ?Your application would not be accepted unless you had checked one of the boxes.?

To ensure that people?s decisions align with the government policy of more organ donors, Sunstein and Thaler counseled that governments should follow the state of Illinois? example and try to influence people by making organ donation seem popular.

?First, the state stresses the importance of the overall problem (97,000 people [in Illinois] on the waiting list and then brings the problem home, literally (4,700 in Illinois),? they wrote.

?Second, social norms are directly brought into play in a way that build on the power of social influences [peer pressure]: ?87 percent of adults in Illinois feel that registering as an organ donor is the right thing to do? and ?60 percent of adults in Illinois are registered,?? they added.

Sunstein and Thaler reminded policymakers that people will generally do what they think others are doing and what they believe others think is right. These presumptions, which almost everyone has, act as powerful factors as policymakers seek to design choices.

?Recall that people like to do what most people think is right to do; recall too that people like to do what most people actually do,? they wrote. ?The state is enlisting existing norms in the direction of lifestyle choices.?

Thaler and Sunstein believed that this and other policies are necessary because people don?t really make the best decisions.

?The false assumption is that almost all people, almost all of the time, make choices that are in their best interest or at the very least are better than the choices that would be made [for them] by someone else,? they said.

This means that government ?incentives and nudges? should replace ?requirements and bans,? they argued.

Neither Sunstein nor Thaler currently are commenting on their book, a spokesman for the publisher, Penguin Group, told CNSNews.com.

In a question-and-answer section on the Amazon.com Web site, Thaler and Sunstein answered a few questions about their book.

When asked what the title ?Nudge? means and why people need to be nudged, the authors stated: ?By a nudge we mean anything that influences our choices. A school cafeteria might try to nudge kids toward good diets by putting the healthiest foods at front.

?We think that it's time for institutions, including government, to become much more user-friendly by enlisting the science of choice to make life easier for people and by gently nudging them in directions that will make their lives better,? they wrote.

??The human brain is amazing, but it evolved for specific purposes, such as avoiding predators and finding food,? said Thaler and Sunstein. ?Those purposes do not include choosing good credit card plans, reducing harmful pollution, avoiding fatty foods, and planning for a decade or so from now. Fortunately, a few nudges can help a lot. ??

Disturbing audio has emerged of White House information czar Cass Sunstein, who in a previous white paper called for banning ?conspiracy theories,? demanding that websites be mandated by law to link to opposing information or that pop ups containing government propaganda be forcibly included on political blogs.
In an audio excerpt of an interview which was posted on the Breitbart.tv website today, Sunstein discusses how conservative websites should provide links to liberal websites and vice versa or even how political blogs should be made to include pop ups that show ?a quick argument for a competing view?.
Sunstein said that if this system couldn?t be implemented voluntarily, ?Congress should hold hearings about mandates,? which would legally force people to dilute their own free speech. The Harvard Professor also said that blogs should be forced to list a random draw of 25 popular websites, such as CNN.com.

?The best would be for this to be done voluntarily,? said Sunstein, ?But the word voluntary is a little complicated and people sometimes don?t do what?s best for our society,? he added (emphasis mine).
?The idea would be to have a legal mandate as the last resort?.an ultimate weapon designed to encourage people to do better,? Sunstein concluded.




As we previously reported, in a January 2008 white paper entitled ?Conspiracy Theories,? the Harvard Professor who is currently President Obama?s head of information technology in the White House called for ?conspiracy theories,? that is any political opinion which didn?t concur with the establishment view, to be taxed or even banned outright.

So-called ?conspiracy theories that Sunstein said could be subject to government censorship included beliefs held by the vast majority of Americans, such as the notion that the JFK assassination occurred as part of a wider plot.
In his white paper, Sunstein also cited the belief that ?global warming is a deliberate fraud? as another marginal conspiracy theory to be countered by government censorship.
Ludicrously, the Harvard Professor even characterized as ?false and dangerous? the idea that exposure to sunlight is healthy, despite the fact that top medical experts agree prolonged exposure to sunlight reduces the risk of developing certain cancers.
Essentially, Sunstein wants it to be written into law that the government can dictate the very nature of reality to Americans and that their opinions can only be voiced at best when accompanied by mandatory federal propaganda or at worst that Americans can be silenced entirely by federal decree.
This callous disregard for the First Amendment represents a fundamental threat the very fabric of the country and is even more alarming considering the position of Obama?s Supreme Court nominee Elena Kagan with regard to free speech. During the Citizens United vs. FEC case, Kagan?s office argued that the government can ban books and political pamphlets. In separate writings, Kagan argued that the government could ?disappear? free speech it deemed to be offensive.

No website with even a modicum of decent tech support would ever have to put up with such edicts. And there's not a damn thing the U.S. government could to force them to comply.

With fanatical zeal that would impress demigods like Darwin, Nietzsche, Justice O.W. Holmes, Trotsky and Hitler, American Progressivism has for over 130 years aggressively dismantled, brick by brick, every aspect of our fundamental natural rights founded under God, natural law and the original intent of the constitutional framers. A major part of this strategy is for utopian socialists to regulate our constitutional rights into oblivion and make us all slaves to the omnipotent socialist State ruled by a small oligarchy of overseers. President Obama's handpicked Cesare Mori is regulatory czar Cass Sunstein, whose fascist motto is: There is no liberty without dependency.

To give you an idea of the utter diabolical ideas of this Marxist academic, look at his 2008 book "Nudge: Improving Decisions About Health, Wealth, and Happiness," where Sunstein and co-author Richard H. Thaler argued to expand the current organ-donor policy – that unless a patient has explicitly chosen to be an organ donor, either on his driver's license or with a donor card, the doctors assume that the person did not want to donate and therefore do not harvest his organs. Thaler and Sunstein want to reinterpret this as "explicit consent."

In America, if a corpse doesn't have the liberty to be buried in peace without legions of ghoulish, body-snatching bureaucrats stealing grandma's liver, kidneys or eyeballs, then what freedom and constitutional rights do you think those of us who are alive will enjoy? …

In a revelatory article by my WND colleague on the unholy pact between Obama, Sunstein and Soros, Aaron Klein wrote the following:
n April 2005, Sunstein opened up a conference at Yale Law School entitled, "The Constitution in 2020," which sought to change the nature and interpretation of the Constitution by that year. That event was sponsored by Soros' Open Society Institute as well as by the Center for American Progress, which is led by John Podesta, who served as co-chair of Obama's presidential transition team. Podesta's Center is said to be highly influential in helping to craft White House policy.

The Yale event on the Constitution was also sponsored by the American Constitution Society, or ACS, which has been described as a group meant to counter the work of the Federalist Society, which has been at the forefront of the push for a more conservative judiciary since its launch in 1982. The ACS is the main organization behind the movement to ensure a more "progressive" Constitution, having received more than $2,201,500 from Soros' Open Society since 2002.
Attorney General Holder served on the ACS board of directors.
Sunstein wrote a blog entry just before that 2005 conference in which he explained he "will be urging that it is important to resist, on democratic grounds, the idea that the document should be interpreted to reflect the view of the extreme right-wing of the Republican Party." The tyrannous effect of Sunstein's coup d'?tat will be to remake the U.S. Constitution into a socialist communist document without having to fire one bullet, or get one vote in Congress.

In his 2005 book, "The Second Bill of Rights," Sunstein outlines the diabolical parameters of this new communist bill of rights:

  • The right to a useful and remunerative job in the industries or shops or farms or mines of the nation;
  • The right to earn enough to provide adequate food and clothing and recreation;
  • The right of every farmer to raise and sell his products at a return that will give him and his family a decent living;
  • The right of every businessman, large and small, to trade in an atmosphere of freedom from unfair competition and domination by monopolies at home or abroad;
  • The right of every family to a decent home;
  • The right to adequate medical care and the opportunity to achieve and enjoy good health;
  • The right to adequate protection from the economic fears of old age, sickness, accident and unemployment;
  • The right to a good education.
Sunstein's contemptible communist propaganda isn't new. Remember that in 1944, Democrat-socialist President Franklin Roosevelt proposed a Second Bill of Rights. Sunstein apparently plagiarized many of his ideas from FDR and the 1977 Soviet Constitution.

Let me be clear, professor Sunstein is one of the most despicable academics I've ever studied who is still alive. What is most reprehensible about Czar Sunstein and the 36-plus books he has written is that not only does he demonstrates an utter contempt for our Constitution, but he also takes absolute delight in using that same Constitution the framers designed to protect us from traitors of his ilk to destroy the capitalist free market and natural law that made this country exceptional above all others.

Sunstein, Soros, Podesta, Obama and other Democratic socialists are in the process of turning our Constitution into a suicide pact.


Sunstein's wife, Samantha Power, is the National Security Council special adviser to Obama on human rights. It was Power who reportedly influenced Obama in his decision to invade Libya despite the fact that America has no vital national interests inside that giant sandbox. But for the national lobotomy this great country has apparently suffered after 160 years of state propaganda most people know as our public school system, a scoundrel like Sunstein (and his Lady Macbeth wife) would be immediately fired, placed in the stocks in the public square and have rotten fruit and dead animals thrown at his face like in Medieval times … but this is only a personal fantasy.

America, please don't allow Soros, Sunstein and Obama to kill the U.S. Constitution through either rewriting it or regulating our sacred constitutional rights into oblivion. Send letters to your congressional representatives and demand that all Republicans refuse to pass a hike in the debt limit and force a government shutdown. This strategy will compel Democratic socialists and RINOs alike to make draconian spending cuts, including defunding entire departments of the federal government, like Education, Commerce, the EPA and most regulatory agencies that are duplicative and fascist.

And let us collectively stab through the heart Sunstein's treachery that "there is no liberty without dependency."
